2018051805-18-2018 : CONTRACT REBID STATUS A Fuels Contract was published in December 2017, and an Announcement of Apparent Successful Bidder was made in February. Enterprise Services is currently in negotiations with REG Marketing and Logistics Group, LLC. If the Fuels Contract is awarded, the current contract (#00311) will be cancelled by region.

2015092509-25-2015 : ADMINISTRATIVE CHANGE DES to revise state bulk fuel master contract, but will not rebid Based on customer feedback and internal review, the Department of Enterprise Services (DES) has determined it is not in the state’s best interest to rebid Master Contract 00311, the bulk fuel contract, but will move forward with revisions to the management fee, effective October 1. DES’s analysis of a prior recommendation to the department found merit in assessing a management fee of $8,500 per year for customers with $3.4-plus million in annual usage. A second part of the recommendation – to rebid the contract – will not be acted on. Background, analysis and rebid decision • Feedback from a key customer, WSDOT, and internal analysis of the contract revealed the required changes can best be accomplished by a contract amendment, rather than a rebid. • Five years remain on a contract that has worked well since its implementation. DES determined that a lengthy, complex, resource-draining rebid is unnecessary at this time. • Going forward, DES will conduct a similar analysis every year and seek stakeholder input to determine the value of the contract and whether it continues to meet the needs of customers. Should there be a future need, DES and customers will collectively decide on a rebid at that time. Management fee revisions • DES has considered the impact of the .74 percent management fee on the bulk fuel contract and has decided to make an exception due to the uniqueness of this contract, its high dollar volume, its volatility, and the extremely low profit margin on the service delivery. • Accordingly, effective Oct. 1, 2015, the revised cost-recovery method on this contract will be $8,500/year for any customer whose annual contract usage meets or exceeds $3.4 million. • DES will separately bill customers exceeding the $3.4 million/year spend, with billing at the end of each fiscal year. • To document this exception, DES will issue an amendment to fuel contract(s) and to the Master Contract Usage Agreement for each of the following customers: ? King County ? Department of Transportation ? Snohomish County PTBAC Community Transit ? City of Seattle ? Pierce Transit • In addition, effective Oct. 1, 2015, all other 00311 Bulk Fuel Contract users will pay a management fee of .25 percent. Individual usage data will determine remittance to the agency at year-end. • To make the contract equitable, all customers exceeding $3.4 million in usage within a calendar year and paying in excess of $8,500 will receive reimbursement for the difference and move to the exception category. 2015080608-06-2015 : CONTRACT CHANGE Effective August 1, 2015 the Applicable Washington State Fuel Tax will increase $0.07 per gallon invoices will reflect the new tax rate of $0.445. This is in conjunction with the re-imposed Washington Petroleum Products Tax at the rate of 0.3 percent effective July 1st, 2015.

2015071607-16-2015 : CONTRACT EXTENSION STATUS Request for extension has been sent to all Contractors with a due date of July 20,2015. The stop date is now May 20th, 2016. CS hopes to have the re-bid completed by Jan 2016 and Contract 00311 will run concurrently with the new contract until the implementation period is complete.
2015060306-03-2015 : CONTRACT STATUS Special Notice: WASHINGTON STATE DEPARTMENT OF REVENUE Re: Petroleum Products Tax re-imposed - Effective July 1, 2015 Beginning July 1, 2015, Washington’s Petroleum Products Tax will be reinstated to fund the Pollution Liability Insurance Trust Account. The current tax rate for tax is .003 (0.3 percent). Petroleum products include plant condensate, lubricating oil, gasoline, aviation fuel, kerosene, diesel motor fuel, benzol, fuel oil, residual oil, and every other product derived from refining crude oil. Crude oil or liquefiable gases are not “petroleum products.” For further information, see RCW 82.23A.010. The tax is calculated based on the wholesale value at the time of first nonbulk possession in Washington. For petroleum products introduced at the rack, the wholesale value is determined when it is removed at the rack. Under the law, possession means control of the petroleum product and includes both actual and constructive possession. The tax is reported on the Washington Combined Excise Tax Return.

2015033103-31-2015 : CONTRACT STATUS The proposed new IFB #00115 - Delivered Fuel: Bulk and Less-than Bulk has been released for Comment with a reply date of April 6th, 2015: Purpose: This is a draft solicitation that the Department of Enterprise Services (DES) MAY USE if and when it rebids the current statewide fuel contract, number 00311. This is not an official solicitation. DO NOT send DES a bid response. The DRAFT is attached as an embedded file near the bottom of this page. The file is authored in MS Office 2010 Word and is in .docx form. The document also contains an embedded MS Excel file that is in .xlsx form. You must have compatible software to open the files. Prior to posting on WEBS, DES has tested the document on multiple computers and it will open if you have compatible software. The file is not corrupted. Prospective bidders are welcome to provide input by email to the DES representative listed below. DO NOT place a phone call as that form of communication will not be accepted for this process. Make sure the email subject line contains at a minimum “00115” and a company name (short version). DES WILL NOT provide responses back to the public but may make individual contact if the input is not understood or DES needs clarification. The input is more effective if it is in the form of a comment versus a question since DES will not be responding. Each issue should be concise, identify the section or sections, and offer a proposed solution such as replacement language (if not overly long). Any issues should be listed in some form of priority with the most important at the beginning/top and least important at the last/bottom. DES will do it’s best to review all input but will pay particular attention to the ones deemed most important (beginning/top). 2014030303-03-2014 : PRICE ADJUSTMENT As part of Procurement Reform and LEAN practices, DES consolidated several program funding streams into one called a management fee. DES began amending the #00311 contract in March 2013 and early on secured amendments with Wilcox & Flegal, Coleman Oil, and Powell-Christensen which has been paying a management fee since 7/1/2013. The Department of Enterprise Services and the Contractors, Associated Petroleum Inc. (APP) and PetroCard Inc., have negotiated a management fee on their portions of the #00311 contract. Effective 3/10/2014 both APP and PetroCard will pay to DES a management fee of .74% (.0074). Both APP and PetroCard requested and were granted a price adjustment in the same amount. The DES Fuel Price Page was revised to include the adjustment which will be live on 3/10/2014

2011080808-08-2011 : E10 Blender’s Credit Not Contractually Required: Contract 00311 has five Contractors serving 16 region/categories. A question was raised regarding the E10 Blender’s Credit. At this time, three of five Contractors appear to be extending an E10 Blender’s Credit. OSP was asked to review the 00311 contract and determine if an E10 Blender’s Credit was a contract requirement. OSP in collaboration with the Department of Transportation and two 00311 Contractors scrutinized the contract and an E10 Blender’s Credit is not contractually required. Further, it appears the only credit required to be passed-through to customers is the Biodiesel Credit (if any). Currently, the way 00311 is designed the Biodiesel Credit is already assumed in the OPIS reference used to determine pricing and would not appear as a separate line item on any invoice. One important note: The 00311 contract allows for the contractor to offer a voluntary price discount. Therefore, it is possible that some 00311 Contractors will continue to offer the E10 Blender’s Credit.

2011052305-23-2011 : CONTRACT STATUS Contract #00311 was awarded on 4/20/2011 with first day of performance scheduled for 5/21/11. The protest review of the award to PetroCard Inc. for the Central Puget Sound – Bulk region is complete (notification made on 5/20/11). The award to PetroCard is upheld; please contact PetroCard for any CPS – Bulk orders. All awarded 16 region/categories are available for 00311 customer use beginning 5/21/11. Please periodically check this site’s current contract information (CCI) and the “Contract Activity” below. Also, fuel contract #07705 expired on 5/20/11. OSP thanks all of the 00705 contractors for their partnership with the state of Washington. 2011052005-20-2011 : CONTRACT STATUS Contract 007705 is replaced by contract 00311 with May 21st, 2011 being the start date. The one exception to 07705 is the continued award for Central Puget Sound – Bulk Delivery. The award for Central Puget Sound- Bulk Delivery has not been awarded due to the current protest under review. 2011042804-28-2011 : CONTRACT STATUS The Office of State Procurement (OSP) has received a protest regarding the Central Puget Sound (Bulk) portion of the award. During the protest period, OSP is not aware of any other protests on any other portions of solicitation #00311. OSP will review the protest and when a final outcome is reached, OSP will post the result as a “Contract Activity.”
