12-29-2011 : | Background – Sole Source Contract: 9/29/11 WSP (Bob Schwent) notified GA (Bob Paulson) that WSP Chief Batiste had made the decision that WSP would expand its partnership and use of the Federal Department of Justice Northwest Zone APCO Project 25 Trunked System in order to meet the Federal Communication Commission’s (FCC) January 1, 2013, deadline for narrowbanding. WSP had determined that the benefits out weighted the negatives for this course of action and it was recognized that a sole source negotiated contract with Motorola would have to be established because the DOJ system was already standardized on Motorola equipment, software and support and that WSP’s expansion had to be interoperable with the DOJ communication system. 10/28/11 Initial meeting at DES between WSP (Bob Schwent, Mike Geiger and Mark Vetsch), DES (Dale Colbert and Bob Paulson) and Motorola Solutions (Joe Mann, Derek Phipps, Joe Piksa, Travis Boettcher, Brad Steiner and Rick Roark) to discuss this WSP Narrowbanding Radio Project and integration with the DOJ Trunked Radio System. WSP provided Motorola with a statement of work/requirements statement (for system design, equipment, installation, training, and support) so Motorola could prepare a proposal to meet WSP’s narrowbanding radio requirements with integration into the DOJ Trunked Radio System by the FCC 1/1/13 narrowbanding deadline. Motorola agreed to prepare a proposal for WSP and DES consideration. 11/4/11 Meeting here at DES building between WSP/DES/Motorola where Motorola provided several copies of its draft proposal and Mr. Phipps walked everyone through major sections of the proposal. WSP agreed to review the technical portions of the proposal and to get back to the group with their findings. 11/7/11 Dale Colbert and Bob Paulson met with Jim Gayton (with the Legal Services group of DES) and asked him to join our contract negotiation team. 11/8/11 Bob Paulson posted to WEBS a two-page memorandum notifying the vendor community that it had been decided: “To complete the narrowbanding and upgrading of the WSP communication system and to successfully integrate with the existing DOJ Northwest Zone APCO Project 25 Trunked System it will be necessary for the state to negotiate a sole source contract with Motorola Solutions.” Additionally it was shared that: “WSP has briefed the Governor’s Office, the Office of Financial Management, and legislative committees on the decision to expand its partnership with the DOJ communication system rather than moving forward on their own. The advantages of this change of direction were shared with the appropriate levels of state government, including the requirement to negotiate a contract with Motorola rather than pursue a competitive bid contracting process.” Lastly vendors were notified that: “Vendors wishing to review this contract between the state and Motorola Solutions may request a copy by filing a public disclosure request once it is fully executed and signed by both parties. Completion of the contract is currently anticipated for the first week of December 2011.” 11/4/11 – 12/7/11 Numerous email and phone discussions were exchanged between DES and Motorola about negotiating wording acceptable to both parties for this agreement/contract 05711. 12/8/11 Derek Phipps signed the proposed and agreed to agreement/contract 05711 on behalf of Motorola Solutions and on 12/09/11 Dale Colbert signed the agreement/contract on behalf of the state. 12/12/11 Discovered most pages of Exhibit C stated in a footer that Motorola considered the material confidential and restricted. Now that the contract has been established, Motorola has agreed to remove this restriction concerning this material and will be stating so in writing to DES. However, we also discovered some information contained within Exhibit C should be redacted prior to release in response to any “public records request” due to WSP radio system infrastructure confidentially. As of 12/20/11, a redacted version of Exhibit C is being prepared for release to third parties. | |
12-28-2011 : | Background – Development of RFP: 7/18/11 Meeting held with representatives from the Washington State Patrol (WSP) (Robert Schwent and others) and the Department of General Administration (GA) (Dale Colbert and Bob Paulson) in which WSP asked GA/OSP to begin the process of developing a competitive bid to award of a contract for the upgrading of WSP’s radio communications system to meet FCC narrowbanding deadline of January 1, 2013. WSP work group members were Bob Schwent, Electronic Services Division Commander; Mark Vetch, Project Lead & Radio Maintenance Manager; and Mike Geiger, Engineering Manager; and OSP work group members were Dale Colbert and Bob Paulson. 9/12/11 GA/OSP received a Purchase Requisition (A15 form) sign by WSP Chief John R. Batiste authorizing GA/OSP to “Purchase a P25 digital radio system (see enclosed specifications for products and services)” for WSP with an estimated value of $33,000,000. 9/22/11 Memorandum from Phil Grigg, Assistant Director with the Department of General Administration to Mike Ricchio, Acting Director, Department of Information confirming their collective understanding that procurement authority for public safety radio equipment was covered under the procurement authority of RCW 43.19 for the WSP Radio Narrowbanding Procurement Project and the re-bid of the WSCA Public Safety Communications Equipment contract 02702. Between 7/18/11 and 9/28/11 project work group members met and corresponded numerous times in an effort to draft a competitive solicitation to meet the needs of the WSP to upgrade and narrowband its radio communications system. |
