Contract Scope The Department of Enterprise Services, through participation with the State of Arizona, has established the contractors shown below in the Contractor section to provide a full range of reseller services and service options to support purchasing entities’ COTS and SaaS based software needs. Categories of solutions are as follows: General Software, Microsoft Software, and Oracle Software. For each of these categories, services related to the software purchase, include but not limited to installation, configuration, maintenance, and advisory services may be offered.

Software purchases for state agencies:Security Design Review from WaTech might be required for your purchase, particularly if an agency’s project requires WaTech oversight, creates risk to state assets outside the agency, or when required by an agency's IT security program (Washington State Securing Information Technology Assets Standards Section 1.2.1). It is the purchasers’ responsibility to assess if the Security Design is applicable for a particular purchase and to work with WaTech to schedule the review: support@watech.wa.gov

Microsoft Enterprise Agreement (EA) : The Microsoft Enterprise Agreement (EA) is for organizations that want to license software. You may purchase products through this EA from the following awarded contractors: SHI, Insight Public Sector, Dell, and CDW-G.

DES has ensured this procurement meets RCW 39.26, follows State of Washington Current Procurement Policies, follows DES procurement process, and DES has determined that entering into this contract will be in the best interest of the State of Washington.

General guidance to purchasers on EULAs
EULAs (End User License Agreements) are required parts of the contract, but agencies shouldn’t agree to all of the terms in a supplier’s EULA without review and considering the risks. EULA terms should be carefully reviewed to make sure they meet the purchaser’s business needs (and risk tolerance). Things like automatic renewals, failures to warranty service levels, and limitations of liability should be carefully considered before signing a EULA. Purchasers should flag and ask to change any terms they object to (indemnification, venue, choice of law, etc.) with state-favorable or neutral terms.
